UK Government Proposes Reforms for AI and Copyright Law

On December 17, 2024, the UK Government released a consultation document titled “Copyright and Artificial Intelligence,” which explores potential reforms to copyright legislation in response to rapid advancements in the AI sector.

The Government outlines several core objectives for a new framework:

  • Ensuring that right holders can maintain control over their content and receive payment when AI developers utilize this content via licensing;
  • Assisting in the development of leading AI models in the UK by enabling AI developers to access extensive online content for training; and
  • Fostering trust between the creative industry and the AI sector through transparency measures that disclose the works used in AI training.

One significant proposal is the introduction of a new text and data mining (TDM) exception that would allow AI developers to analyze large datasets for developmental purposes, provided they have legal access to the data and rights are not expressly reserved.

The Government recognizes the importance of transparency in AI development, noting that understanding how AI models are trained can help enforce copyright and ensure compliance. They are considering the introduction of regulations requiring AI developers to disclose details about the datasets and works utilized, thus enhancing accountability.

Additional discussions revolve around the status of AI-generated content under copyright law, particularly concerning computer-generated works (CGWs), which the Government is looking to reform. Proposals include altering the originality requirement for CGWs to allow for better protection or potentially revoking it altogether for works produced entirely by AI without human involvement.

The consultation has garnered attention from stakeholders, as feedback remains open until February 25, 2025. The Government expresses its commitment to developing a robust framework that will likely necessitate future legislation, particularly in light of ongoing legal disputes around AI and copyright. As discussions continue, the implications of these potential reforms could significantly impact both creators and AI developers in the UK.
