California Legislators Confront AI Price Discrimination
California lawmakers have set their sights on artificial intelligence practices that enable businesses to charge customers varying prices based on personal data. In recent weeks, five new bills were introduced to tackle the growing concern over predictive pricing models that unfairly target consumers.
Companies like Amazon, ride-sharing services, and retailers, including Staples and Target, are known to employ such practices. These businesses can manipulate pricing based on a customer’s online behavior or demographic information. For instance, a recent report found that a Bay Area hotel charged an individual $500 more than guests from less affluent regions.
According to research by Justin Kloczko of Consumer Watchdog, a non-profit organization backing the legislative efforts, “They’re literally trying to hack your brain. They’re trying to read your mind and what you want.” Kloczko stated that discrepancies in pricing based on customer profiles exemplify the often imperceptible nature of this technology-driven discrimination.
This set of bills aims to limit the power of algorithms that utilize nonpublic competitor data for pricing strategies. Assemblymember Cecilia Aguiar-Curry has introduced a measure to empower the California Attorney General to pursue legal action against businesses exploiting such algorithms.
Furthermore, legislative proposals include significant restrictions on pricing algorithms that adjust costs based on user characteristics or personal details, with some aimed at the rental market. One notable measure would allow tenants to sue landlords for the application of automated pricing technologies following concerns arising from the lawsuit against RealPage, a firm accused of using flawed algorithms for tenant selection.
State Senator Melissa Hurtado has also reintroduced legislation to curtail algorithmic pricing. The bills signify a growing legislative response to an increased number of tech policy proposals, as highlighted by the National Conference of State Legislatures, which saw a substantial rise in AI legislative initiatives.
Consumer Protection and Future Considerations
Amid pressing concerns over consumer protection, California lawmakers continue to grapple with balancing regulatory measures and fostering innovation in the tech industry. The ongoing dialogue in the state legislature seeks to address the pervasive issue of AI-driven discrepancies in pricing while keeping an eye on the potential economic impacts and future challenges likely to arise, particularly as these technologies become more advanced.
Lawmakers are notably conscious of Governor Gavin Newsom’s stance on regulatory matters and whether forthcoming legislation may face vetoes, which could influence the final outcomes of these proposals.
Vinhcent Le, a participant in the legislative discussions, expressed cautious optimism, stating, “I’m excited about the bills we’ve seen so far but the big questions are where the governor and federal government will take action in this arena.”
