Kenya is making significant strides in establishing a regulatory framework for artificial intelligence (AI). Between January 14 and 19, 2025, the Ministry of Information, Communications, and Technology held consultations on a draft of Kenya’s National AI Strategy 2025-2030, which aims to position Kenya as Africa’s leader in AI innovation. Launched formally on March 27, 2025, the strategy emphasizes building a robust governance framework, fostering AI adoption in key sectors, and developing local AI ecosystems, all grounded in principles of ethical, inclusive, and equitable deployment.
Key initiatives include the potential development of national data, AI, emerging technologies, and cybersecurity policies. The Kenya Bureau of Standards (KEBS) also released a Draft Information Technology AI Code of Practice in April 2024 to promote responsible AI use, though it remains in draft form. Meanwhile, the Kenya Robotics and AI Society Bill 2023 is in draft but has yet to be introduced or supported by the government, facing opposition from stakeholders.
Additionally, Kenya’s prior efforts include the establishment of a Taskforce to explore disruptive digital technologies, highlighting the challenge of balancing innovation with safety and human rights. Existing laws such as the Data Protection Act 2019, the Cybercrimes Act 2018, and the Consumer Protection Act 2012 influence how AI is approached in Kenya, though no specific laws define or directly regulate AI yet.
Kenya’s strategy defines AI as a collection of emerging technologies leveraging machine learning, data processing, and algorithms to perform tasks typically requiring human intelligence. Although the regulatory frameworks are still evolving, Kenya aims to harmonize regional laws to facilitate cross-border AI development and use. The focus remains on establishing data governance, risk management, and compliance standards without current enforcement powers or penalties. The overall goal is to support sustainable AI growth that can benefit all citizens and position Kenya as a leading regional hub.
