Spain’s Bold Move Against AI Misuse: Massive Fines for Unlabelled Content

On March 11, 2025, Spain’s government advanced a significant bill aimed at enhancing transparency in artificial intelligence applications. The new legislation mandates that companies must adequately label content generated by AI, with severe fines for those who fail to comply, reflecting an effort to combat the surge of “deepfake” content in the digital landscape.

Digital Transformation Minister Oscar Lopez, in a press briefing, emphasized the necessity of these regulations, stating, ‘AI is a very powerful tool that can be used to improve our lives … or to spread misinformation and attack democracy.’ He noted that this bill aligns with guidelines established by the European Union’s AI Act, which aims to enforce more stringent obligations on high-risk AI systems.

As one of the first EU nations to adopt such comprehensive regulations, Spain’s legislation proposes penalties that can reach up to 35 million euros ($38.2 million) or 7% of a company’s global annual turnover for failing to comply with labelling requirements deemed a “serious offence.” This step signifies a notable contrast to the United States’ largely voluntary AI regulatory framework.

Furthermore, the bill encompasses measures to prevent harmful practices such as subliminal messaging and the misuse of biometric data. While it grants authorities permission for real-time biometric surveillance for national security, it imposes restrictions on organizations using AI for unethical profiling.

Lopez remarked that the fight against deepfakes and misinformation is critical as technological advancement continues. ‘Everyone is susceptible to deepfake attacks,’ he stated, pointing to the vital need for protective regulations in the ever-evolving digital landscape.

The newly established AI supervisory agency, AESIA, will oversee enforcement of these regulations, while specific areas concerning data privacy and security will be handled by dedicated agencies.
